Level of Services

We provide 2 levels of service:
1. Grant of Probate only; and
2. Applying for the grant, collecting and distributing the assets.

Grant of Probate Only:

If the estate is a straight forward estate, we can act for executors to obtain Grant of Probate only, allowing the executors to administer the estate.

The cost of obtaining the Grant of Probate is based on a fixed fee of £649 + VAT and the applicable disbursements as listed below.

Applying for the grant, collecting and distributing the assets

Obtaining the Grant of Representation and dealing with the administration of the estate can become complicated, it can take several months to make sure everything is done properly. at Sutton & Co. solicitors we offer a complete administration service to deal with everything for you.

Every estate is different, which is why we encourage you to contact us so that we can provide you with an estimate outlining the range of potential fees to make sure that you get the right amount of support to meet your individual circumstances. we will update you regularly on your costs throughout the matter so that you can stay in control throughout.

We will do the following:

  • a solicitor and not a case handler will deal with your file;
  • advise you in connection with obtaining the appropriate grant of representation to the estate;
  • advise you in connection with the administration of the estate including the legal, taxation and administrative matters;
  • complete the Probate application form, HM Revenue and Customs forms, an oath for Personal Representatives in order to obtain Grant of Representation;
  • liaise with HM Revenue and Customs to make payment of any inheritance tax (if any);
  • collect assets in the estate and pay debts and liabilities;
  • place Trustee Act notices in the Gazette and local paper in order to protect the executors;
  • prepare estate accounts;
  • distribute the estate once the estate accounts are approved.

Simple Estate

We anticipate that this will take between 10 and 20 hours work at £150 per hour. Total costs estimated would be between £1500 and £3000.

The exact cost will depend on the individual circumstances of the matter. For example, if there is one beneficiary, one property and one bank to correspond with, our costs will be at the lower end of the range. If there are multiple beneficiaries, a property and multiple bank accounts the costs will be at the higher end.

We will handle the full process for you. This quote is for estates where:

No Claims against the Estate

Complex Estate

We anticipate that this will take between 30 and 60 hours work at £150 per hour. Total costs estimated would be between £4500 and £9000.

The exact cost will depend on the individual circumstances of the matter. For example, if there are five beneficiaries, a property and liquid assets of less than £500,000.00, our costs will be at the lower end of the range. If there are more than five beneficiaries, several properties and multiple bank accounts with inheritance tax liability due the cost will be at the higher end.

How long will this take?

Grant only basis

If we are instructed on a Grant only basis this will take between 2 and 4 months.

Administering a simple estate

On average, estates that are not subject to inheritance tax are completed within 6-12 months.

Administering a complex estate

Estates which are subject to inheritance tax take on average between 12 and 24 months.

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

Potential Additional Costs

  • If there is no will or the estate consists of any share holdings (stocks ad bonds) there is likely to be an additional cost that could range significantly depending on the estate and how it is to be dealt with. We can give you a more accurate quotation once we have more information;
  • Dealing with foreign assets, however, we are able to coordinate advise with professional advisers in other jurisdictions but only to the extent specifically agreed in writing between us which may incur an additional cost;
  • Providing advice in relation to actual claims made against the estate, or contentious matters in dealing with the administration of the estate - these would be a separate matter. We are able to coordinate with other professional advisers on how this impacts the administration of the estate but only to the extent specifically agreed in writing between us which may incur an additional cost;
  • If any additional copies of the grant are required, they will cost 50p (1 per asset usually);
  • Dealing with the sale of transfer of any property in the estate is not included.
